I know yall been waiting for it!!!!

The response after being "confronted" with their own TOS. (AKA the biggest cop out of them all)

Dear LiveJournal user brandipoo,

As you have noted, the content in question has been deleted at this time. As our only recourse in situations such as this, if violations of LiveJournal's Terms of Service are present, is to require removal of the content, no additional action is necessary at this time.

Additionally, we note that additional portions of LiveJournal's Terms of Service are relevant to this situation. Specifically, Section XIV, 1, which states "Within the confines of international and local law, LiveJournal will generally not place a limit on the type or appropriateness of user content within journals." We also note that Section XVI, which you have cited, specifically states that, should content be found in violation, "it will be LiveJournal's sole discretion as to what action should be taken." In situations such as this, it is our long-standing policy that users are given the freedom to express themselves, provided they do not explicitly threaten or encourage violence against others.

While we understand and appreciate your concern with the content in question, it is considered permissible under the Terms of Service and the ideal of free speech.

Naw...FUCK that!!! Sum this up thus: While it is in violation of our TOS, at the same time, it's not a violation of our TOS because we randomly and arbitrarily decide what does and does not violate the TOS, nor are we obligated to enforce our own TOS, thus making HAVING a TOS pointless, because when we feel like it anyone can do anything to anyone so long as we don't really give a shit enough to care, and after all, I personally am not black so who gives a fuck if someone calls a black person a nigger and says that they deserve to be lynched, which should be a violation of our TOS. But in this case, it's not for no other reason than...well, hell, there really is no reason. We're just choosing to ignore our own policy in this case because we can.

Oh. And even though we claim all that would have been done was to make her delete the offensive material, and all the relevant posts in booju_mooju have been deleted--thus deleting the pic magentathompson made (is that right?), her account is still suspended anyway.

At this rate LJ will become like AOL very soon, probably sooner than soon. The mods moderate what they chose to moderate. I was in another community where someone made a very violent comment, that kind of comment got someone banned on TWoP, but the mod of the LJ group just gave a warning and that was it, they didn't even take the post down and the post was advocating the death of someone.

All this crap seriously reminds me of what used to go down on AOL message boards on a daily basis.

But, if LJ does become like AOL, I take comfort in that fact, because AOL's going down the craphole for its dumbassery and back-aswards policies. LJ won't be far behind :)

I say all of us with paid accounts petition NOT to renew them when the time comes (even though I WILL miss my custom layouts and LJ free of ads). A handful of us have said separately we won't renew, maybe going to them collectively will show them us darkies aren't happy and we're not going to give them our hard earned money!

I've written them myself.

This is what they wrote in return:

Thank you for contacting us. We cannot use screencaps for determining if a violation has occurred on the LiveJournal service. We can only use content that directly resides on the service for this. Likewise, we would need to hear directly from the affected individual in this matter as we cannot accept reports from concerned third parties.

LiveJournal defines hate speech as any content that incites (or calls to action) others against another individual, social or ethnic group. We define it as such to protect freedom of speech and expression. We acknowledge that many people do not get along and/or hold opinionated views on subjects that are deemed socially unacceptable and downright offensive. While we may not personally agree with these opinions or viewpoints, we will not censor an individual’s right to state them. Once we begin censoring our users for specific words used, regardless of social implication, we leave ourselves in a position where we must then censor any and all speech used on our service. We cannot take sides or play favorites and would need to address any complaint of speech that an individual found to be offensive, regardless of implication or context.

We do understand and empathize with any distress caused over allowing this kind of language to be used on our service. We cannot however take any action on it as the use of the word in context is not a violation of our Terms of Service, policies or United States law. We have reviewed the information provided concerning this user and the matter in question and have determined that it appears to be a flame war between users that became heated. One of the users involved made the poor decision to use language and context that is offensive and degrading but unfortunately, in its use, not a violation that we may act upon. Freedom of speech must be accepted with both the good and the bad aspects of that speech. This has always been LiveJournal’s policy and will hopefully remain so.

We do apologize if our decision on this matter has offended you and if you feel we are being disrespectful in some fashion. That is not our intent. We very much do care about all of our users and their feelings and try to hold you in the highest regard. We do agree with you that the use of this word in context is offensive and upsetting, but we must protect our users rights to say it under freedom of speech regardless of how we or others may feel about it personally.
